Overview In this role you will provide expert legal guidance to BioMarin's Market Access function, shaping pricing, reimbursement, and contracting strategies in a highly regulated environment. You will partner with cross-functional teams to ensure compliance and protect the company's integrity while supporting product access and patient services. You'll navigate Medicaid, 340B, pricing transparency, and health policy developments to enable strategic commercial initiatives. This is an opportunity to influence how therapies reach patients while balancing legal, regulatory, and business considerations.
Responsibilities- Advise on commercial initiatives aligning with strategy while managing legal risk
- Provide counsel on Medicaid, Medicare, 340B, and Veterans Affairs requirements
- Support government pricing, price reporting, and final CMS rules
- Counsel on contracts with payers, PBMs, GPOs, distributors, IDNs, and providers
- Draft and negotiate rebates, value-based, distribution, data licensing, and patient support agreements
- Ensure compliance with Anti-kickback, pricing transparency, and healthcare laws
- Collaborate with Legal and Compliance to deliver comprehensive advice
- Participate in Medical Legal Reviews and external communications
- Contribute to the Legal & Compliance Department initiatives and knowledge sharing
- Monitor evolving healthcare regulations and enforcement landscapes
Key requirements- JD from an ABA-accredited law school
- Bar admission in a state
- Minimum 8 years post-JD experience in life sciences legal matters
- Experience advising on market access, government pricing, contracting in pharma
- Knowledge of Medicaid, 340B, anti-kickback, and drug pricing transparency laws
- Strong communication and ability to translate legal concepts for non-lawyers
- Experience managing outside counsel and budget alignment
- Experience with specialty medicines is highly desirable
